प्राथमिक शिक्षक संघ कुशीनगर के ब्लॉक स्तरीय चुनाव पर रोक लगाने हेतु दायर याचिका पर "सब रजिस्ट्रार" फर्म सोसाइटी एवं चिट्स को 2 माह में प्रत्यावेदन पर निर्णय लिए जाने हेतु मा0 उच्च न्यायालय का आदेश
In this writ petition, the petitioners have prayed for following
principal reliefs:-
"(i) issue a writ, order or direction in the nature of mandamus directing the
respondent authorities to hold election of Uttar Pradesh Pradeshiya
Prathamik Shikshak Sangh at Block level in District Kushi Nagar on the
post of President (Block Adhyaksha) and Secretary (Block Mantri)
according to the bye-laws of Uttar Pradeshiya Prathamik Shikshak Sangh
by following Section 14, Clause ka, kha, ga, gha and da of bye-laws
framed by the Association.
(ii) issue a writ, order or direction in the nature of mandamus directing the
respondent authorities to permit the petitioners to submit their nomination
paper to participate in the election of Uttar Pradeshiya Prathamik Shikshak
Sangh at Block level in District Kushinagar.
(iii) issue a writ, order or direction in the nature of mandamus directing the
respondent no.2 to take action on the representations of the petitioner
dated 26.2.2018 (Annexure No.6 to the writ petition)."
Learned counsel for the petitioners states that the petitioners
have already filed a representation dated 26.2.2018 before the
respondent no.2 for redressal of their grievance, which is still
pending. He has confined his prayer only to the relief that the
representation dated 26.2.2018 may be considered by the
appropriate authority.
Learned Additional Chief Standing Counsel for the State
respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition
pending.
In view of above, without expressing any opinion on the merits
of the issue and considering the facts and circumstances of the
case, this writ petition is disposed of finally with a direction to
the Sub Registrar, Firms, Societies and Chits, Lucknow Region,
Lucknow to decide the petitioners' representation in accordance
with law within a period of two months from the date of
production of a certified copy of this order before him.
